The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 307, 379/34 of the Indian Penal Code. It is alleged that petitioner no. 1 namely Pappu Singh, petitioner no.2 namely Raju Singh, petitioner no. 3 namely Champa Devi and co-accused Tinku Singh came armed with lathi entered in the house of the informant, when Pappu Singh abused the informant. On protest being made, the petitioners assaulted with iron rod to the informant. When mother, brother and wife of the informant came to rescue, they were also assaulted by the accused persons. The accused persons also snatched gold

Patna High Court Cr.Misc. No.37439 of 2015 (2) dt.16-09-2015 chain from the neck of the informant.

It is submitted by the learned counsel for the petitioners that the petitioners are agnates of the informant. The injuries of the informant's side have been found to be simple in nature. There is counter version of the occurrence. The petitioners'' side have also received injury. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 93 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
