JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 354B, 447 of the Indian Penal Code and section 3(1) (x) (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the petitioner abused the informant by calling caste name and gave life threatening, if sale deed with regard to particular land is not executed.

It is submitted by learned counsel for the petitioner that that father-in-law of the informant took Rs.4,30,000/- from the petitioner's side and was not executing the sale deed and in the background of land dispute the accusation has been levelled. For the occurrence of 07.01.2015, the FIR was registered on

Patna High Court Cr.Misc. No.37377 of 2015 (2) dt.15-09-2015 2/2 10.01.2015, which reached to the court on 12.01.2015. Considering the accusation being levelled in the background of dispute with regard to execution of sale deed and delayed lodging of the FIR as well as delayed reaching to the court, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in connection with Muzaffarpur Town SC/ST P.S. Case No.3 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
