JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 353, 337, 338, 420, 120B, 307 of the Indian Penal Code, 27 of the Arms Act, 33, 41, 42 of the Indian Forest Act and 4(1), 4(1-a) of the Mines and Minerals (Development and Regulation) Act, 1957. The prosecution case is that the police raided the place of running illegal crasher unit, when the crasher machine was seized then the villagers attacked the police force. A 'dumpher' was found parked near the crasher unit and the petitioner was identified to be the driver of the said 'dumpher'.

Patna High Court Cr.Misc. No.38813 of 2015 (2) dt.30-09-2015 It is submitted by the learned counsel for the petitioner that the petitioner is the President of crasher unit association, hence the petitioner has been roped in the present case and First Information Report has been lodged against 26 named and 400-500 unknown. There is no specific accusation against the petitioner. Though, the petitioner was accused in one other case of similar nature in which he has been granted bail and only on suspicion the petitioner has been roped in the present case. Considering the omnibus and general accusation against mob, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.

10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Dihri, Rohtas in connection with Dihri Nagar P.S. Case No. 251 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K.
