The petitioner, already in custody since 30.01.2018, seeks bail in connection with Bihariganj P.S.Case No. 286 of 2017 registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Accusation in brief, is that, on the exhortation given by this petitioner, 07 persons, named in the FIR from Uday Yadav to Munna Mandal, shot indiscriminately at the informant's husband causing his death.

Contention of the learned counsel for the petitioner is that there is no accusation against the petitioner of resorting to fire on the deceased rather he is said to be the order giver and Rudal Yadav and Sudhir Yadav both are alleged to have shot at

No.42385 of 2018(3) dt.09-08-2018 2/2 the deceased, have been admitted to bail by a coordinate bench of this Court vide Cr.Misc.No. 19997 of 2018 and Cr.Misc.No. 22437 of 2018 respectively and the petitioner has no criminal antecedent and investigation has been completed. Having considered the aforesaid facts and circumstances, the petitioner, namely, Uday Kant Yadav@ Uday Yadav is directed to be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class Udakishunganj, Madhepura in connection with Bihariganj P.S.Case. No. 286 of 2017.
