Mr.Dilip Kumar No. 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 16-07-2025 Heard Mr. Rajeev Kumar, learned counsel appearing on behalf of the petitioner and Mr. Dilip Kumar No. 1, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Alamganj P.S. Case No. 1048 of 2024 registered for the offence(s) punishable under Sections 147, 148, 323, 341, 307, 379, 325, 506, 448 and 354 of IPC ( 126(2), 115(2), 74, 303(2) , 352, 351 and 3(5) of the BNS).
3. As per the allegation made in the FIR, the accused persons named therein including the petitioners assaulted the informant and her son and they also outraged the modesty of the
Patna High Court CR. MISC. No.41838 of 2025(2) dt.16-07-2025 2/3 daughter of the informant.
4. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and they have falsely been implicated in the present case due to land dispute. Both the parties are agnates. There is case and counter case between the parties. Petitioner no.2 has filed Alamganj P.S. Case No.1047 of 2024 against the informant family members and in retaliation, the present FIR has been lodged by the informant. Earlier also in the year 2023, Alamganj P.S. Case No.1151 of 2023 was filed by the petitioners side, whereas Alamganj P.S. Case No.1152 of 2023 was lodged by the informant side.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.
6. Considering the nature of allegation made against the petitioners and also the fact that there is case and counter case between the parties, who are agnates, I am of the opinion that petitioners have, prima facie, made out a case to be released on pre-arrest bail.
7. The petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/-
Patna High Court CR. MISC. No.41838 of 2025(2) dt.16-07-2025 3/3 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Patnacity in connection with Alamganj P.S. Case No. 1048 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS.
8. The learned District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases, as what has been stated in paragraph no.3 of the bail application, this order will automatically lose its force.
