JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-07-2017 The petitioner seeks bail in connection with Kahalgaon (Shiv Narayanpur) P.S. Case No. 452 of 2016 registered for offences punishable under sections 149, 341, 323, 376, 504, 506 of the Indian Penal Code and section 4 of POCSO Act.

The allegation against the petitioner is commission of rape of minor girl.

It has been submitted on behalf of the petitioner that the prosecution story is not supported by the medical report, no injury was found on her body. Petitioner is in custody since 23.12.2016.

Heard learned APP also.

Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant bail to the

Patna High Court Cr.Misc. No.33871 of 2017 (2) dt.21-07-2017 petitioner. However, learned 1st Additional Sessions Judge, Bhagalpur is directed to conclude the trial of the petitioner. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J.) veena/- U T
