Petitioner and one another co-accused are said to have committed rape on the informant and petitioner was caught on the spot. The victim appears to have supported the accusation in her statement recorded under section 164 of the Cr.P.C. Considering the aforesaid facts and circumstances as well as submissions of the parties, I do not feel it proper to release the petitioner on bail and, hence, his prayer for bail in connection with Madhowrah P.S.case No.48 of 2016, pending in the court of Chief Judicial Magistrate, Saran at Chapra stands rejected.
