JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2017 The petitioner seeks regular bail in connection with Amba P.S. Case No. 57 of 2017, registered for offences punishable under Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of 32 litres of country made liquor.

It has been submitted on behalf of the petitioner that nothing has been recovered from conscious possession of the petitioner and he has falsely been implicated in this case and has been in judicial custody since 17.05.2017 and so far other criminal antecedent is concerned, he is on bail in that case. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.39964 of 2017 (2) dt.22-08-2017 circumstances of the case, this application is disposed of with direction to the trial court to expedite the trial and try to conclude it within a period of three months and if the trial is not concluded within the aforesaid period, he will release the petitioner on bail to his own satisfaction.
