The petitioners have preferred this application for grant of regular bail in a case registered under sections 461 and 379 of the Indian Penal Code.

As per the prosecution case, the informant discovered the lock of the shutter of his shop to be broken and goods worth Rs.9 lacs missing.

It is submitted by learned counsel for the petitioners that the F.I.R. was registered against unknown. The name of the petitioners transpired in the confessional statement of coaccused Md. Istakhar who has been enlarged on bail vide order dated 14.2.2022 passed in Cr. Misc. no.48347 of 2021. The

Patna High Court CR. MISC. No.52187 of 2021(4) dt.03-03-2022 2/2 allegation that some of the stolen tyres were recovered from the kabari shop of the petitioners are false and incorrect. The petitioners are in custody since 6.6.2021 and have no criminal antecedent. Chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with grant of bail to co-accused Md. Istakhar on whose confessional statement before the police, the name of the petitioners transpired including the petitioners having remained in custody for 9 months, the Court directs the two petitioners to be enlarged on bail in connection with Supaul P.S. Case no.368 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul.
