The petitioner seeks bail in a case instituted under Sections 420, 468, 467 and 471 of the Indian Penal Code. The allegation against the accused persons including the petitioner is of committing misappropriation of huge amount of government money by forged posting of receipt and amount with assistance of 3-4 meter reading staffs.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.09.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not
Patna High Court Cr.Misc. No.50312 of 2016 (2) dt.21-11-2016 2/2 named in the First Information Report. His name has come in course of investigation. The other co-accused have been granted bail vide Annexures-2 and 3 to the present application. On behalf of the counsel for the Bihar State Electricity Board and counsel for the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S.
