JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 14-08-2019 From perusal of the report of the learned lower court sent vide Letter No. 64/Bhagalpur dated 22.07.2019, it appears that charge in the case has been framed on 06.11.2017, but no witness has been examined by the prosecution till date and learned lower court has sought three months more time to conclude the trial.
While rejecting the bail prayer of the petitioner vide order dated 08.10.2018, learned lower court was directed to conclude the trial as expeditiously as possible preferably within nine months from the date of receipt/production of a copy of the order and S.P. Bhagalpur was directed to ensure production of the witnesses in the case on each and every date fixed without fail, but despite aforesaid direction, trial has not been concluded within the aforesaid stipulated period.
Patna High Court CR. MISC. No.39947 of 2018(5) dt.14-08-2019 2/2 Having regard to the facts and circumstances of the cae, learned lower court is directed to conclude the trial positively within four months from the date of receipt/production of a copy of this order fixing the case on day to day basis and SP/Bhagalpur is directed to ensure the production of the witnesses in the case on each and every date fixed without fail else the court shall be constrained to take serious note against him.
