The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 364/34 of the Indian Penal Code and section 27 of the Arms Act. As per prosecution case, the petitioner along with coaccused persons forcibly abducted and dragging the informant into four wheeler in which seven persons were seated armed with pistols, lathi & rods who started firing upon the prosecution party.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to enmity. No specific allegation attributed to the petitioner rather general and omnibus

Patna High Court CR. MISC. No.43941 of 2023(2) dt.21-07-2023 2/2 allegations leveled against him. Other co-accused namely, Bhola Kumar upon whom the similar allegation has been made, is already getting the privilege of bail granted by a co-ordinate Bench of this Court vide order dt. 27.2.2023 passed in Cr. Misc. No. 57503 of 2022. The petitioner has got no criminal antecedent as stated in para-3 of the petition. Moreover, he has suo-motto surrendered before learned court below on 5.4.2023 and sense then, he is languishing in custody. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Muffasil P.S. Case No. 145 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Begusarai.
