This application is for grant of regular bail in connection with Beldaur P.S.Case No.81 of 2017, G.R.No.1134 of 2017, registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioner is of killing the deceased, who happens to be husband of the deceased. Submission of the learned counsel for the petitioner is that except confession of the co-accused, there is nothing against the petitioner and prior to that he had lodged a case against the family members of the deceased because he had taken money and not returning the same. Now the petitioner is in custody for more than three months.

Patna High Court Cr.Misc. No.34022 of 2017 (3) dt.09-08-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail stating that apart from the confession, there is an eye witness and the bricks were found inside the room by which the deceased was murdered.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

With the aforesaid observation, this application is dismissed.
