Petitioner seeks bail in Falka (Pothia) P.S. Case No.48 of 2018 instituted for the offence under Section(s) 307 and other allied Sections of Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, V, Katihar. In the written report, there is allegation that this petitioner brutally assaulted the informant with axe causing injury on his head, nose, ear, neck etc.

Case diary has been received in which injury report is available. The Doctor has found five injuries on vital part of body, which were grievous in nature caused by sharp cutting weapon.

In such circumstances, this Court is not inclined to

Patna High Court Cr.Misc. No.42109 of 2018 (3) dt.24-09-2018 2/2 enlarge the petitioner on bail.

Prayer of the petitioner for grant of bail is rejected. Liberty is given to the petitioner to renew his prayer for bail after six months if no substantial progress is made in the case.
