JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in Sour Bazar P.S. Case No. 15 of 2017 instituted for the offence under Sections-25(i-B)a, 26 and 35 of the Arms Act.
It is alleged that two country-made pistols and three live cartridges have been recovered from house of the petitioner No. 1. The seizure list is enclosed with FIR wherein there is no signature either of the petitioners or his family members. One Rupesh Yadav has put signature over the seizure list. In paragraph-3 of the petition, it has been mentioned that the petitioners have no criminal antecedent.
In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sour Bazar P.S. Case No. 15 of 2017 to
Patna High Court Cr.Misc. No.37413 of 2017 (2) dt.08-08-2017 the satisfaction of learned Chief Judicial Magistrate, Saharsa subject to condition that both the bailors should be close relative of the petitioners.
