The petitioner seeks bail in Kamtaul P.S. Case No. 222/2017, registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

The informant is father of the victim girl. The informant alleged that on 22.12.2017 at 1.00 p.m., petitioner enticed his minor girl for the purpose of marriage.

It has been submitted that the petitioner and the victim appeared themselves before the police. In the statement recorded under Section 164 Cr.P.C. the girl has stated that she went along with the petitioner out of her own will for marriage. Petitioner has not committed any sexual assault upon her.

Patna High Court Cr.Misc. No.39786 of 2018 (3) dt.14-09-2018 2/2 Petitioner is in custody since 28.12.2017.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Darbhanga in connection with Kamtaul P.S. Case No. 222/2017.
