2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Kankarbagh P.S. Case No. 245 of 2025 instituted for the offence under Section 310(2) of the B.N.S.

3. The case of the prosecution is that the petitioner along with others have looted Rupees One crore from the informant which was the consideration money of the plot.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He also submits that the petitioner has annexed the

Patna High Court CR. MISC. No.40774 of 2025(2) dt.25-07-2025 2/3 boarding pass of 17.03.2025 and has also annexed the bill of the Hotel City Walk, Bhopal. It has also been submitted that these documents were shown to the I.O. as well but without any investigation, the I.O. has concluded that petitioner is the conspirator and he has willingly kept himself out of Station to show his innocence. The documents which has been annexed by the petitioner shows that on the date of the occurrence, he was not in Patna. From perusal of the order of the trial court, it transpires that the anticipatory bail of this petitioner has been rejected on the assumption that he is the conspirator. He next submits that one of the co-accused who was apprehended, has been granted bail by the trial court itself. It has lastly been submitted that a statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.

5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner and submits that the petitioner's name finds place in the list of persons who are alleged to have looted the said amount.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of
