The petitioners seek regular bail in Siwan Muffasil P.S. Case No.321 of 2017 registered for the offence under Sections 341, 323, 379, 504 and 506/34 of the I.P.C.

Allegation as per the F.I.R. against the petitioners is of snatching Rs.10,000/-, abusing and also attempted to give knife blow to the informant. Submission of the learned counsel for the petitioners is that petitioner no.1 is an ex-sergeant in Army and petitioner no.2 is his younger brother. Further

Patna High Court Cr.Misc. No.42892 of 2017 (2) dt.18-09-2017 2/3 submission is that the car of the informant dashed the motor cycle of petitioner no.2 due to which the occurrence took place and thereafter making false allegation the present case has been filed. Now the petitioners are ready to abide by the conditions imposed upon him.

Having heard both sides and in view of the facts and circumstances, as stated above, and also the petitioners are in custody for more than two months, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/-each with two sureties of the like amount each to the satisfaction of C.J.M., Siwan, in Siwan Muffasil P.S. Case No.321 of 2017 subject to the conditions that (1) one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The petitioners will not induce any witness or tamper with the evidence. (3) The petitioners shall co-operate in disposal of trial and make himself
