1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 318(4), 338, 336(3), 340(2), 119(1) and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioner no. 1 has antecedent of six cases out of which four cases are under the Excise Act and petitioner nos. 2 and 4 have antecedent of two cases and petitioner nos. 3 and 5 are persons
Patna High Court CR. MISC. No.44597 of 2026(2) dt.28-07-2026 2/3 with clean antecedent. It is next submitted that informant alleges that his land was fraudulently sold by Rakesh, Dinesh and Rasbihari.
4. The learned counsel submits that petitioner nos. 1 and 5 purchased land from Dinesh while petitioner nos. 2, 3 and 4 purchased land from Rasbihari. It is next submitted that petitioners are purchasers of land and they purchased the land considering that the transaction was genuine. It is further submitted that a Ramanand Yadav along with three others had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 34647 of 2026 and the same came to be allowed by an order dated 19.05.2026 passed by a learned Coordinate Bench. It is further submitted that informant till date has not filed an application before a Court of competent jurisdiction for canceling the sale deed with respect to the land executed in favour of the petitioners. It is also submitted that if informant's files an application seeking cancellation of sale deed in that event the petitioners will appear and contest the same.
5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners and also taking into consideration the
Patna High Court CR. MISC. No.44597 of 2026(2) dt.28-07-2026 3/3 order dated 19.05.2026 in Criminal Miscellaneous No. 34647 of 2026, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Banjariya P.S. Case No. 11 of 2026 subject to the conditions as laid down under Section 482 (2) of the BNSS.
