The petitioners seek regular bail in connection with Chabilapur P.S. Case No. 53 of 2023 registered for the offence under Sections 341, 323, 337, 307, 379, 504, 506/34 of the Indian Penal Code.

As per prosecution case, allegation against the petitioners is that he along with co-accused persons assaulted the informant and his family members due to which they sustained injuries. Thereafter, the FIR has been lodged. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. They

Patna High Court CR. MISC. No.43483 of 2023(2) dt.21-07-2023 2/2 have falsely been implicated in this case due to dirty village politics. The present case is the counter blast of Chabilapur P.S. Case No. 54 of 2023 which was lodged by the petitioner no.2. Both parties sustained injuries in as alleged separate occurrence. Both the petitioners have got no criminal antecedent as stated in para-3 of the bail petition. It is further submitted that the petitioners are languishing in judicial custody since 17.4.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of petitioners, this court is inclined to enlarge them on bail. The above named petitioners are directed to be released on bail in connection with Chabilapur P.S. Case No. 53 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Nalanda.
