Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379 of the Indian Penal Code.

It is alleged that the engine of the tractor of the informant was stolen, when suspicion was raised against Mantu @ Jitendra Prasad. The petitioner was not named in the First Information Report. His name sprang up on the confession of co-accused Chhotu Yadav.

It is submitted by the learned counsel for the petitioner that Chhotu Yadav was with inimical terms with Dara Yadav, who is sarhu of the petitioner. On the basis of compromise Chhotu Yadav has been granted regular bail by the learned court below.

Patna High Court Cr.Misc. No.38944 of 2015 (2) dt.01-10-2015 Considering the fact that the name of the petitioner sprang up on the confession of co-accused Chhotu Yadav, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Arwal P.S. Case No. 171 of 2014, pending in the court of learned Chief Judicial Magistrate, Arwal. With the above observation this application is disposed of.
