20-10-2016 Heard Sri Umesh Chandra Verma, learned counsel for the petitioner and Mr. Matloob Rab, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 08-08-2016 in Excise Case No. 232 of 2016 registered for offence under Section 47(A) of the Bihar Excise Amendment Act, 2016, has prayed for grant of bail.

Learned counsel for the petitioner, by way of referring to statement made in paragraph - 3 of the petition, submits that petitioner is having clean antecedent. He submits that on accusation of recovery of 1.8 litres of country-made liquor from back of the house, the petitioner has been apprehended and

Keeping in view the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Sanjay Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Excise Case No. 232 of 2016.
