Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Nawada P.S. Case No. 05 of 2022 lodged under Sections 147, 148, 149, 341, 323, 325, 308, 379 and 504 of the Indian Penal Code.
As per prosecution case, 5 named and 10 to 15 unknown accused persons have attacked on the informant side. Specific allegation against the petitioner is to attack by iron rod due to which the informant become injured.
Learned counsel for the petitioner submits that from the F.I.R. itself it transpires that there was land dispute between
Patna High Court CR. MISC. No.41963 of 2022(2) dt.02-11-2022 2/2 the parties. Counsel further submits that there is a case and counter case for the same date and place of occurrence. Counsel further submits that there was an open fight took place between the parties and injury took place from both the sides. Counsel further submits that petitioner is a man of clean antecedent and he is in custody since 22.05.2022.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Nawada P.S. Case No. 05 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
With this observation, the bail application stands allowed.
