The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 25(1-b)AA, 26(i)(ii), 35 of the Arms Act.

As per prosecution case, the allegation against the petitioner along with other accused is that they have indulged in manufacturing the illegal arms. The petitioner along with other co-accused apprehended on the spot and from the place of occurrence incriminating weapons and other materials were recovered.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case merely on the basis of suspicion. Neither the

No.41930 of 2023(2) dt.14-07-2023 2/2 seized articles have been recovered form the alleged corn field of the petitioner nor from his conscious possession rather the same have been recovered from co-accused Chhedi Yadav as per seizure list. The police party has not prepared the seizure list u/s 100 of Cr.P.C. It is also submitted that petitioner is languishing in judicial custody since 05.03.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Khagaria P.S. Case No.216 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
