JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2017 Heard the parties. The petitioner seeks bail in Suia P.S. Case No.08 of 2017 for the offence under Sections 302, 201,34of the I.P.C.

Allegation against the petitioner is that he along with other accused persons has killed the deceased. Submission of the learned counsel for the petitioner is that there is land dispute between the parties and for that Katoriya P.S. Case No.217/09 was instituted regarding murder of the brother and the father of petitioner no.1by co-accused, Bikash Yadav. It has been submitted that

Patna High Court Cr.Misc. No.45111 of 2017 (5) dt.06-11-2017 2/3 earlier he moved for anticipatory bail but during the pendency of his bail petition he was arrested and other similarly situated co-accused had been granted bail vide order dated 21.09.2017 passed in Cr.Misc.No.27301 of 2017. Further submission is that he is in custody since 27.06.2017 and there is general and omnibus allegation against the petitioner.

Heard learned A.P.P.also as well as the informant.

Having heard both sides and in view of the facts and circumstances, as stated above, and similarly situated co-accused has already been granted anticipatory bail, let the petitioner, be released on bail on furnishing bail bond of Rs.25,000/-with two sureties of the like amount each to the satisfaction of A.C.J.M.-Ist, Banka, in Suiya P.S. Case No.08 of 2017subject to the conditions that one of the bailors must be of local person having sufficient immovable property within the jurisdiction of the court
