JUSTICE BIRENDRA KUMAR ORAL ORDER 23-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149/341 /324 /302 / 342/364/201/506 of the Indian Penal Code and Section 27 of the Arms Act.

The F.I.R. named accused persons allegedly committed murder of the uncle of the informant by causing firearm injury. The petitioner is not named in the F.I.R. Name of the petitioner transpired during investigation as members of the unlawful assembly. Similarly situated co-accused Harendra Singh @ Harendra Rai and another have been allowed bail by this Court in Cr. Misc. No.52755 of 2016 on 13.01.2017.

Considering the aforesaid facts, let petitioner,

Patna High Court Cr.Misc. No.47928 of 2016 (4) dt.23-01-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Danapur, Patna/Successor Court, in connection with Bihta P.S. Case No.526 of 2016.
