Mr. SURESH PRASAD SINGH ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 19-08-2017 I have heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under Sections 272, 273, 414/34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 468 litres of country-made liquor were recovered from a Safari vehicle which was being boarded by two persons including the petitioners. Petitioners claims that they are having clean antecedent and are in custody since 1.7.2017. Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on

Patna High Court Cr.Misc. No.38804 of 2017(2) dt.19-08-2017 2/2 bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Gaya in connection with Sherghati (Dobhi) P.S. Case No. 348 of 2017 with a condition that one of the bailers of the petitioners belongs to State of Bihar.

If the petitioners, after his release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
