Petitioner is languishing in custody in connection with Sahebpur Kamal P.S. Case No. 72 of 2016 for the offences punishable under Sections 47 of the Bihar Excise (Amendment) Act, 2016.

Foreign liquor was recovered from the house of the petitioner on 12.05.2016.

Submission is that there was no ban on possession of foreign liquor on the alleged date of recovery. The petitioner is in custody since 19.08.2016.

Considering the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.52708 of 2016 (2) dt.07-12-2016 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Begusarai/Successor Court, in connection with Sahebpur Kamal P.S. Case No.72 of 2016.
