The petitioner seeks bail in Halsi P.S. Case No. 170 of 2015 under Sections 307, 387 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.
There is specific allegation against the petitioner that he and others demanded extortion and on refusal, he fired causing injury on the neck of the Informant Gopal Yadav. It is submitted that it is a counter version but from perusal of the injury report, it appears that the firearm injury hit on the neck of the informant and the injury opined to be grievous in nature.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail.
Patna High Court Cr.Misc. No.43678 of 2016 (3) dt.15-12-2016 2/2 Accordingly, the same is rejected.
The petitioner may renew his prayer for bail after remaining one year in custody.
