JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Kotwali P.S. Case No. 22 of 2020 for the offence under Sections 379, 461 and 511of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that he was involved in attempting to commit theft of money from ATM machine and the alleged ATM machine was damaged but the petitioner failed to withdraw money from the ATM machine. The petitioner was not named in the first information report and his name surfaced on the confessional statement of co-accused Md. Afroz @ Sanjay Khan. Petitioner is in custody since 28.01.2020.

Afroz @ Sanjay Khan and petitioner is in custody since 28.01.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 22 of 2020.
