The application is for grant of bail for the offence under Sections 147, 148, 149, 307, 353 of the Indian Penal Code as well as Section 25 (1-B) A/26/27/35 of the Arms Act. It is submitted on behalf of the petitioner that there is allegation of recovery of one country-made Rifal and 75 cartridges.
It is further submitted that the petitioner is in custody since 04.08.2015 and the other co-accused, having similar allegation, have already been granted in Cr. Misc. No.22742 of 2016, Cr. Misc. No.10075 of 2016 and Cr. Misc. No.2032 of 2016. Heard leaned A.P.P. also, who could not controvert that
Patna High Court Cr.Misc. No.47936 of 2016 (4) dt.19-12-2016 2/2 the other co-accused, having similar allegation, have already been granted bail.
Having heard both sides and in view of the fact that there is allegation of recovery of a Rifle and 75 cartridges from the possession of co-accused, having similar allegation, who have been granted bail by this Hon'ble Court, as well as in view of the facts as stated above, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of 1st Assistant Additional Sessions Judge at Saharsa in connection with Sessions Case No.19 of 2016 corresponding to Salkhua P.S.Case No.164 of 2015 with a condition that he will co-operate in trial and make himself available on each and every dates, if required, otherwise his bail bond is liable to be cancelled.
