====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Sonepur P.S. Case No. 402 of 2014 registered for the offence punishable under Sections 465, 466, 467, 468, 471, 420 and 34 of the Indian Penal Code.
The prosecution case, in short, is that the accused persons had promised employment for the son of the informant and had demanded a sum of Rs.3,00,000/- from him for the said purpose. Subsequently, one accused Prabhu Narayan Singh had taken a sum of Rs. 2,00,000/-, for the said purpose, however, no employment was provided to the son of the informant and when they had demand money, the said accused persons had refused to return it.
The learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.33575 of 2017 (2) dt.20-07-2017 2/2 petitioner has no role to play in the money transaction, the petitioner has a clean antecedent, the main accused person i.e. Prabhu Narayan Singh has already been granted bail by this Court by order dated 20.08.2015 passed in Cr. Misc. No. 33316 of 2015 and the petitioner is in custody since 30th March, 2017. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM, 1st, Chhapra, Saran in connection with Sonepur P.S. Case No. 402 of 2014.
