JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioners seek bail in connection with Pusa P.S. Case No. 36 of 2017 registered for offences punishable under sections 147, 148, 149, 341, 323, 324, 325, 307, 354, 452, 504, 506 of the Indian Penal Code.

Allegation against the petitioners and other co-accused persons of assault to the informant.

Learned counsel for the petitioners submitted that there is general and omnibus allegation against them and nothing specific has been attributed and injuries are simple in nature The petitioners have been in custody for about three months. Heard learned A.P.P. also.

Having heard both sides and considering the

No.34924 of 2017 (2) dt.03-08-2017 aforementioned facts and circumstances, let petitioners above named be released on bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Samastipur, in connection with Pusa P.S. Case No. 36 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners will not adduce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the Court and on the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail.
