Petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.
The F.I.R. relates to train dacoity by unknown criminals. Name of the petitioner transpired in the confessional statement of co-accused and petitioner is in custody since 19.12.2015.
Submission is that the seizure list at Annexure-2 would reveal that a bag was seized from Falagu river just beneath the railway crossing and it was seized by the informant. After arrest the petitioner was never put on TIP.
Considering the material and period of custody
Patna High Court Cr.Misc. No.42847 of 2016 (3) dt.13-12-2016 already undergone by the petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Gaya/Successor Court in connection with Gaya Rail P.S. Case No. 115 of 2015.
