JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-11-2021 The present writ petition has been filed seeking disposal of the representation filed by the petitioner on 19.08.2019 (Annexure-3 to the writ petition) regarding minimization and fixation of rent fee/license fee at Jaynagar Railway Market of the plot in question which was allotted to the petitioner.

The learned counsel for the petitioner, at the outset, submits that the petitioner would be approaching the General

The learned counsel for the Railways Shri Anil Singh, Advocate submits that in case the petitioner files appropriate representation, the same shall be considered, in accordance with law and disposed off expeditiously.

Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with liberty to the petitioner to file appropriate representation before the respondent no. 3 and in case such a representation is filed within a period of four weeks from today, the same shall be disposed off by a reasoned and a speaking order, in accordance with law. It is needless to state that in case the petitioner files representation within a period of four weeks from today, no coercive action shall be taken against him for forcibly evicting him from the premises in question on the ground of non-payment of demand raised, till the disposal of the same. The writ petition stands disposed off on the aforesaid terms.
