JUSTICE RAKESH KUMAR ORAL ORDER 20-10-2016 Heard Sri Ashok Kumar Jha, learned counsel for the petitioner and Sri Nand Kishore Prasad, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 14.7.2016 has prayed for grant of bail in Sonbarsa P.S. Case No. 147 of 2016 registered for the offence under Section 272, 273 of the Indian Penal Code and Section 47(a) of the Bihar Excise Amendment Act, 2016.

It was submitted by learned counsel for the petitioner that from an abandoned hutment about 42 liters of country made liquor was recovered and petitioner was apprehended on an allegation that he was fleeing away. By way of referring to the statement made in paragraph no. 3 of the petition he submits that petitioner is having clean antecedent.

Patna High Court Cr.Misc. No.43117 of 2016 (2) dt.20-10-2016 2/2 Learned Additional Public Prosecutor has opposed the prayer for bail.

However, considering the nature of accusation, period of custody and clean antecedent of the petitioner let the petitioner Ram Pravesh Rai be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi / concerned court in connection with Sonbarsa P.S. Case No. 147 of 2016.
