2. The petitioner has preferred this application for grant of regular bail in connection with Narayanpur P.S. Case No. 15 of 2025 dated 27.02.2025 registered for the offences punishable u/ss 303(2), 317(2) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, one stolen motorcycle was recovered bearing Reg. No. BR03V-9427.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has surfaced in this case only on the basis of the recovered mobile and photo of the petitioner. The petitioner was not apprehended on the spot.

The co-accused person has already been granted bail by the Coordinate Bench of this court vide order dated 31.07.2025 passed in Cr. Misc. No. 46191/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.02.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the said stolen motorcycle was recovered which belonged to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Narayanpur P.S. Case No. 15 of 2025.

7. The application stands allowed.
