JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 379, 411, 34 of the Indian Penal Code. Allegation against the petitioner is that there was recovery of stolen motor cycle from the possession of the petitioner.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case. It is further submitted that the petitioner is in custody for about five months having clean antecedent.
Heard learned A.P.P. also.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing
Patna High Court Cr.Misc. No.39113 of 2017 (3) dt.24-08-2017 2/2 bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Divya Prakash, Judicial Magistrate, 1st Class, Purnea in connection with Tikapatti P.S.Case No. 37 of 2017, subject to the condition that one of the bailors should be a local person having sufficient immovable properties within the jurisdiction of court concerned and also with a condition that he will co-operate in trial and appear before the court on each and every date fixed in the case, failing which his bail bond shall be liable to c be cancelled.
