2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 303(2) of the Bhartiya Nyaya Sanhita, 2023.
3. The case of the prosecution is that the informant had parked his Bolero near the house of Nathuni Dewan and had gone to take some refreshment. After some time, when he returned he found that the bolero was missing.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that this case was registered against unknown miscreants. During course of investigation, one co-
Patna High Court CR. MISC. No.40880 of 2025(3) dt.20-08-2025 2/2 accused Satendra Mahto has disclosed the name of this petitioner as his associate. Nothing has been recovered from the possession of the petitioner. Moreover, he is languishing in judicial custody since 04.04.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that the petitioner is having criminal antecedent of three cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nautan P.S. Case No. 24 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bettiah, West Champaran.
