Petitioners are apprehending their arrest in connection with Sitamarhi P.S.Case No.39 of 2019 , registered for offences punishable under Sections 461, 462, 379 of the Indian Penal Code.

As per the FIR, the informant had gone out of in connection with the treatment of his mother and handed over the shop to one Deepak Chaurasiya and when he returned, he found the lock of the shop broken and the computer, Invertor batra, laser printer and other articles valued of Rs.02 lac were missing and further stated that the printer which was kept in

Patna High Court CR. MISC. No.41855 of 2019(4) dt.27-09-2019 2/2 the box valued of Rs.2,40,000/- was also missing. He has named the petitioner no.2 as accused.

Submission of the learned counsel for the petitioners is that they have been made accused only on the basis of the suspicion and there is no recovery from their house or from their possession. They are ready to abide by any condition imposed upon them.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is allowed and the provisional bail granted to the petitioners dated 09.07.2019 is confirmed.
