The petitioner apprehends his arrest in Special Case No.4413/19 arising out of Gardanibagh P.S. Case No.289 of 2019 registered under Section 30(a), 34 of Bihar Prohibition and Excise Act.

The informant got secret information and raided a dilapidated quarter situated in Road No.34, Chitkohra and recovered Indian made foreign liquor and toddy. The informant further disclosed that when he inquired secretly, the informant got information from secret sources that the petitioner, Rishi Keshri and Deepak Chandrabanshi had kept liquor in the dilapidated quarter.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.40623 of 2019(2) dt.02-07-2019 2/2 nobody has seen the petitioner keeping liquor in the quarter and the informant on his own secret information, for the reasons best known to him, named the petitioner.

Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Gardanibagh P.S. Case No.289 of 2019 corresponding to Special Case No.4413/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
