The petitioner seeks bail in Kasma P.S. Case No. 5/2019, instituted for offence under Section(s) 341, 323, 307, 34 of the Indian Penal Code read with Section 27 of Arms Act. It is alleged in the written report that on the date of occurrence petitioner assaulted the informant with butt of pistol causing head injury. Thereafter petitioner caused firearm injury on the neck of informant on account of which he fell down. Injury report is available in case diary wherein doctor has found firearm injury on the person of injured. It is mentioned in the injury report that informant has sustained penetrating wound of 2cmx2cm with charring of surrounding skin and incised wound of size 3cm x 1cm over left parietal

Considering the fact that there is direct allegation against this petitioner of causing firearm injury to the informant, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected.
