JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 16-02-2022 Heard both the parties through video conferencing. Learned counsel for the petitioners prays to withdraw the anticipatory bail application of the petitioner no.1 as he has already been arrested.

Accordingly, the bail application of the petitioner no.1 is dismissed as having become infructuous.

The petitioner seek bail in anticipation of his arrest in connection with Sonepur P.S. Case No.326 of 2019 instituted for the offences under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is no overt act alleged against the petitioner. All the family

The specific allegation of using farsha is on Golu Kumar and other co-accused has also been granted anticipatory bail by this Court. Having considered the allegation and there is no specific overt act has been assigned to the petitioner and other co-accused have also been granted anticipatory bail, I am inclined to grant benefit of anticipatory bail to the petitioner no.2 and in the event of arrest, he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
