JUSTICE SUDHIR SINGH ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 393, 412, 413 and 414 of the Indian Penal Code and 25(1-b) A, 26 and 35 of the Arms Act.
Allegation against petitioner is that in course of search by police arms and ammunitions were recovered from the house of petitioner.
It has been submitted on behalf of petitioner that she is in custody since 7.10.2016. She has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that from the house of petitioner two country made pistols along with 17 cartridges are said to have been recovered. She is a lady. There is no compliance under Section 100 of the Code of Criminal Procedure. Petitioner has no concern with the said arms.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.53523 of 2016 (2) dt.16-12-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Patna City, in connection with Bypass P.S. Case no. 113 of 2016.
