JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2019 This application, for grant of anticipatory bail, arises out of Kanhauli P.S. Case No. 123/18, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.
Allegation against the petitioners and others is that they came variously armed and abused the informant and specific allegation against these petitioners is that they assaulted the informant by means of Katta on his head.
Submission of learned counsel for the petitioners is that there is case and counter case between the parties and both the sides have sustained injuries in the occurrence and though the doctor has opined the injuries to be dangerous to life,

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Kanhauli P.S. Case No. 123/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
