2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 137(2), 103(1), 238 and 3(5) of the BNS.
3. The case of the prosecution is that the son of the informant, namely, Sandeep Kumar (the deceased) was missing from 25.01.2025 and his mobile was switch off. During course of investigation one Nisha Kumari and Dharmraj Kumar have given their confessional statement. From the confessional statement of Nisha Kumari it transpires that she had relationship
Patna High Court CR. MISC. No.41486 of 2025(3) dt.06-08-2025 2/3 with the deceased and her father has killed the deceased. In the confessional statement of Dharmraj Kumar it has come that he called this petitioner for assisting him in disposing off the body.

Learned counsel for the petitioner submits that the only role which has been attributed to the petitioner in the confessional statement of Dharmraj is that the petitioner has helped him in disposing off the dead body of the deceased. The petitioner is a man of clean antecedent and he is in judicial custody since 26.03.2025.
5. Learned counsel for the Informant is present. He has vehemently opposed the bail. Relying on the confessional statement of Dharmraj, he has submitted that this petitioner was also indulged in assaulting the deceased and has relied on the post-mortem report which shows that the deceased was having various injuries. .
6. If the confessional statement of Dharmraj is taken to be true for some moment, then also the only allegation against this petitioner is that he has helped the main assailant Dharmraj in disposing off the body.
7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named

Case No. 18 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Lakhisarai.
