JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 29-09-2015 Heard learned counsels for the petitioner, Spl. P.P. and the informant.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 341, 323, 324, 307, 504 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that the petitioner and others came variously armed, assaulted the informant and abused by calling caste name.

It is submitted by learned counsel for the petitioner that the informant side tease the girl of the petitioner side and when the protest was being made as a result the accusation has been levelled and injury has been found to be simple when there is a counter version of the occurrence also.

Patna High Court Cr.Misc. No.38805 of 2015 (2) dt.29-09-2015 2/2 A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is submitted by learned counsel for the informant that the accusation is specific.

Considering the nature of accusation and the counter version, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sandesh P.S. Case No. 67 of 2015 pending in the court of learned Chief Judicial Magistrate, Bhojpur at Ara. With the aforesaid observation, this application is disposed of.
