JUSTICE ARUN KUMAR ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State The petitioner, who is in custody, seeks bail in connection with Mushari P.S. Case No. 80/16 registered for offence under Sections 458, 380, 401 and 411 of the Indian Penal Code and Section 47A of the Bihar Excise (Amendment) Act, 2016.

Allegation against the petitioner is that he and other miscreants were making an attempt to commit theft inside cigarette factory but escaped. Later on his name disclosed by a co-accused and the only material against the petitioner is that on search of his house, bottle of foreign liquor was recovered from beneath the bed. It is submitted that the petitioner has no criminal antecedent and has been in custody since 18.6.2016.

No.55565 of 2016 (4) dt.08-02-2017 Having considered the said facts and circumstances, the petitioner Devlal Sahni, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Mushari P.S. Case No. 80 of 2016. (Arun Kumar, J) S.Sb/- U T
