JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner, in the present case, is seeking regular bail in connection with Ram Krishna Nagar P.S. Case No. 79 of 2017, registered for the offences punishable under Sections 457, 380 and 511 of the Indian Penal Code.

Learned counsel for the petitioner submits that so far as the present petitioner is concerned he was not caught hold of by the informant on the spot. The accused who was caught by the informant is said to have disclosed the name of two other persons one of whom is the present petitioner but there is no recovery from his possession. The petitioner has got two more cases on his head

Patna High Court Cr.Misc. No.32780 of 2017 (2) dt.20-07-2017 2/2 however, in those two cases he is enjoying privilege of regular bail.

Learned A.P.P. for the State opposed the prayer for bail.

In the facts and circumstances of the case, let the petitioner, above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Sukul Ram, learned Sub-Judge-cum-A.C.J.M., Patna in connection with Ram Krishna Nagar P.S. Case No. 79 of 2017, subject to the condition, under Section 437(3) of the Cr.P.C., that one of the bailors would be a close family member having no criminal antecedent and the petitioner shall co-operate in trial, and two regular default in putting appearance before the trial court shall lead cancellation of bail bonds.
