JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act. The first information report was lodged against nine named accused persons and it is specific in the first information report who fired on the deceased. Petitioner is not named but in course of investigation, petitioner was arrested in connection with Matihani P.S. Case No. 74 of 2015 and confessed his guilt disclosing his involvement in the present case. Thereafter, charge sheet was submitted against the petitioner and one co-accused, Bachhu Mishra @ Bibhash Mishra @ Bibhash Kumar Mishra. It appears from the aforesaid fact that except the above stated
Patna High Court Cr.Misc. No.46870 of 2016 (2) dt.26-10-2016 2/2 confessional statement of the petitioner as well as some criminal antecedent, there is nothing against him. Moreover, co-accused, Bachhu Mishra @ Bibhash Mishra @ Bibhash Kumar Mishra, having similar allegation, has already been granted privilege of bail by this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Begusarai in connection with Sessions Trial No. 54 of 2016 arising out of Matihani P.S. Case No. 24 of 2015.
